Workers in North Carolina who suffer injuries on the job have the right to file for workers’ compensation. One of their options is total temporary disability. It’s important to understand the details of this workers’ comp benefit.

What Workers Are Covered By Workers’ Compensation?

Employers of three or more employees must carry workers’ compensation insurance. Anyone who is an employee of a company whether they work full- or part-time, is eligible for benefits.

The types of workers covered by workers’ compensation are broad. Those performing internships or apprenticeships, undocumented workers, sole proprietors and even minor employees are entitled to file if they suffer on-the-job injuries.

What Is Temporary Total Disability Coverage?

One of the types of workers’ compensation benefits available in injured employees is temporary total disability. This coverage is given to a worker shortly after they have suffered their injury or work-related illness and are unable to work. It’s provided when the worker is out while recovering. Workers entitled to this coverage must wait seven days before they can begin receiving temporary total disability benefits. They can receive benefits for up to 500 weeks and in certain situations even longer.

Workers qualified for these benefits receive two-thirds of their average weekly wages. A worker can continue receiving their benefits until they have returned to work or are no longer considered disabled.

How Can a Worker Qualify for Temporary Total Disability Benefits?

When a worker seeks temporary total disability from workers’ compensation, they must prove their disability to qualify for benefits. A doctor treating the person can assign work restriction to prove their disability and inability to work.

Workers who are injured at work and unable to do their job should immediately notify their employer and apply for workers’ comp.

The nursing profession comes with many risks. For example, remaining close to sick patients could result in a nurse catching an illness. North Carolina health care facilities present other dangers to nurses, and severe injuries might result. Learning about possible injuries may decrease the chances of getting hurt on the job.

Nurses Face Many Injury Risks

Is there any profession that comes without the risks of slip-and-fall accidents? Nursing duties may find someone dodging all kinds of trip hazards. A patient might spill a drink, and a nurse could slip and suffer a bad fall. Poorly placed equipment or furniture may cause a fall, too.

A patient’s careless behavior could lead to harm. Sometimes, a patient might be abusive and violent, leaving a nurse in danger. Struggling with a patient may result in fractures or worse. Unfortunately, violent outbursts are not always predictable.

Cuts and punctures cause everything from minor cuts to deep lacerations. Nurses work with and around sharp objects, and among them are needles, scissors, and scalpels. Even a minor cut might require stitches and some time away from work to prevent infection.

Exposure to toxic substances ranks high on the list of nursing profession hazards. A mishap near toxic materials could result in burns, lung irritation, and worse.

Time Away From the Job

Nurses know that injuries require time and rest to heal. Whether missing a few days of work or a few months, a nurse might worry about financial troubles after an on-the-job injury. Bills will continue to arrive even when someone is sick and recovering. Filing for workers’ compensation benefits might result in payments that cover many expenses.

Workers’ compensation applications typically require detailed evidence about the injury. Applicants will benefit from ensuring that their submitted documents are complete and accurate.

North Carolina workers who have jobs that require manual labor and strenuous lifting are at a higher risk of developing a shoulder injury. Rotator cuff injuries tend to be the most common, and they’re brought on either suddenly or over time through excessive wear and tear. While there are a number of stellar treatments to remedy this type of injury, it’s best to avoid getting one in the first place.

Use Proper Lifting Techniques

One of the best tips to follow to prevent having to file a workers’ compensation claim for a shoulder injury is to always lift with your arm held squarely against your body. When lifting, you should be using the power of your legs and hips to do most of the lifting. Keep in mind that your quads and hamstrings have a lot more power than your arms. Use this knowledge to your advantage when moving heavy objects.

Pay Attention to the Position of Your Spine

You always want to keep your spine as upright as possible when lifting heavy objects. When you utilize the power of your lower body to do most of the lifting, it allows you to keep your spine in an upright position. In addition, you’ll notice that your arms will be less fatigued when you let your lower body do most of the lifting. Letting your upper body get fatigued and continuing to push through the fatigue is one of the most common ways to develop a shoulder injury in the rotator cuff muscles.

Shoulder injuries are one of the most common workplace injuries for those in the manual labor industries. It’s important to do your part in preventing the development of a shoulder injury by practicing the prevention techniques that we went over above. Remember that it’s always best to prevent an injury as opposed to dealing with having to treat it after it develops.

Going to work should mean coming home in the same condition. But falls in some types of work environments are common, and despite great efforts to prevent workplace injuries, it can be difficult to completely get rid of dangers. There are some techniques that you can use to stay safer from ladder injuries while at work in North Carolina.

Tips to Prevent Ladder Falls

One of the most important things that you should do is use the right ladder for a particular job. For instance, if you’re working near electricity, you should avoid metal ladders. Another thing that you should ensure is that the ladder is in good working condition before you use it. You should inspect the ladder to ensure that all of the rungs are in good condition, and you should never modify a ladder. Finally, make sure that you’re using ladders the way that they were intended, and make sure that you place ladders on solid surfaces.

Injuries Are Down But Could Be Even Less

You didn’t go to work to get hurt, and you should be reasonably assured that you’ll return home in the same condition that you left for work. The number of workplace injuries in some occupations has decreased, but you still have to be on the lookout for potential hazards. In fact, as recently as 2019, 186 people in North Carolina died while at work because of an accident.

It’s impossible to completely avoid danger in any kind of work environment, but there are some things that both employers and their employees can do to lessen the likelihood that accidents will happen. However, if you have been injured on the job, you might want to meet with an attorney to learn more about the workers’ compensation process.

Every employee makes an agreement with their employer when they show up for work. The employee agrees to exchange time for dollars, with the presumption that when those hours are complete, they will be able to return home in essentially the same condition as they arrived. Your employer has a legal duty to protect you from certain dangers associated with the tasks to which they assign you. These dangers can be as ordinary as slipping on a wet floor in the kitchen of a restaurant, or as complex as being struck by a falling beam on a construction site. This duty is explained through the complex set of laws and rules that control Occupational Safety and Health requirements.

Each year the North Carolina Department of Labor publishes the statistics of workplace injuries from the prior year. There is no doubt that the current statistics are far better than they were 20, 10, or even five years ago. But accidents do still happen. In 2019, 186 of North Carolina’s workers lost their lives on their jobsite. For comparison, New York lost 273 workers due to workplace fatalities, California lost 451, and Texas lost 608.

However, an employee’s right to recover under North Carolina’s Workers Compensation law does not depend upon proving that the employer was negligent. Under Workers Comp, you are entitled to recovery if you are injured by an accident or occupational disease while at work.

If you have been injured in a workplace accident, an attorney might be able to help you protect your family from the financial hardships of losing your paycheck. If your employer has denied your claim, an attorney might be able to help you seek a second opinion. If your employer has accepted your claim, but the insurance company is either withholding care or you feel that the care is not working, an attorney may be able to help get you the care that you deserve.

Call Baddour, Parker, Hine and Hale today if you have been injured in an accident at work. We offer free consultations, and you may pay no fees unless we recover for you. Your family depends on you, and you trusted the employer to hold up their end of the deal. If they did not, you may be entitled to significant financial compensation.

Construction workers face a high risk for injuries and even fatalities here in North Carolina, and this risk holds nationwide. For this reason, construction employers must take the following steps to ensure a safe workplace.

Careful planning and risk management

Everything starts with planning ahead for a given project. The managers of that project should make sure to take certain preventative measures and then communicate these to workers. The workers should have the right tools and personal protective equipment. Perhaps managers could perform a hazard assessment, especially if workers will be on elevated platforms. Falls are to blame for one-third of all construction fatalities.

Employers can better manage risk if they know that most construction deaths arise between 10 a.m. and 3 p.m. and hit their peak at noon. Workers should be aware that summers are the most dangerous, largely due to the increase in heat-related illnesses and exhaustion.

Prudent scheduling and a safety-minded culture

Scheduling must take the reality of worker exhaustion into account. Employers must not extend a worker’s shift too often, even when there’s a real talent shortage. Lastly, employers cannot simply force all of these safety-minded measures on workers from above. Employers must make an effort to create a culture of safety. Team-building activities and ongoing education can help in this regard.

Legal representation for injured employees

Under workers’ compensation law, injured construction workers can be eligible for benefits, assuming that the injuries are work-related and that workers did not cause those injuries because of negligent behavior like alcohol intoxication. Employers can deny benefits for a number of reasons, which would necessitate an appeal; because this can get complicated, it may be beneficial for victims to have legal representation from the beginning. A lawyer may work to ensure that victims receive compensation for medical bills, lost wages and so on.

Employers are expected to record significant workplace injuries and illnesses on OSHA’s Form 300. OSHA has criteria as to what injuries and illnesses must be recorded, so employers in North Carolina and elsewhere should be familiar with these. However, even an informed employer may face the challenge of determining if a particular situation falls under the guidelines. There are gray areas to navigate, after all.

This is where XpertHR, the well-known provider of human resources tools, comes in with its Top 10 Q&As and Checklist for OSHA Compliance. Failure to comply with the guideline for record-keeping can result in serious penalties. With this checklist, however, employers can know how to evaluate every situation in light of OSHA’s criteria.

XpertHR even gives real-life scenarios along with the way one can evaluate them. Some of these scenarios are cases of workers fainting on the job; being injured on business trips; and suffering ergonomic injuries, such as repetitive motion injuries. There are also scenarios involving seasonal workers.

OSHA requires all injuries that require medical treatment beyond standard first aid to be recorded. Other injuries that must be recorded include those that lead to time taken off work, loss of consciousness, the victim being transferred or restrictions on the work the victim continues to do.

Regardless of the severity of the on-the-job injury or illness, an employee may seek workers’ compensation reimbursement. Unlike a personal injury claim, a victim does not need to prove that any negligence occurred. Still, they may be denied payment if they were at fault, in which case they would probably have to mount an appeal. It may be wise to leave all of this to a lawyer. A successful claim could cover a victim for some lost wages and all medical expenses.

Most workers who are injured in Goldsboro or elsewhere in North Carolina work for businesses and corporations that employ more than a handful of employees. Owners of almost every business of any size are required to maintain workers’ compensation insurance to remain in compliance with state law. Employees who are injured or become ill on the job are afforded certain rights including receiving reasonable and essential medical care.

North Carolina law mandates that employees must notify their employers of their on-the-job injury within at least 30 days of it having occurred. Employers must readily provide their workers with any essential medical care that they need right away after being notified that an injuring accident having occurred. Employees are required to see the doctor of their employer’s or their insurer’s choosing.

State law allows employees to seek out their medical care at their employer’s expense if their company doesn’t provide them with a medical referral after reporting their on-the-job injuring accident being to them.

Injured or ill workers can change physicians if they’re unhappy with the one that they’re sent to see. An injured employee must petition the North Carolina Industrial Commission to do so though. There’s no guarantee that a worker will have their bills paid by their employer in such an instance unless the employee first receives written permission to change doctors though. Such permission must be received before any treatment commences.

While workers get hurt on the job every day in the United States, procedures for handling such injuring incidents vary by state, employer and various other factors. An attorney can review the details of your case and advise you how you may be able to get your employer to pay your medical bills and lost wages.

Data published by the National Safety Council (NSC) captures how a new employee is injured every seven seconds here in North Carolina and the rest of the country. This means that 510 workers are hurt each hour or 12,600 of them are injured each day. Around 4,600,000 individuals are hurt on the job each year. Certain workers perform specific tasks that are more vulnerable to getting hurt than others.

The occupations with the highest injury rates include production and manufacturing, community service workers such as police and firefighters and manufacturing ones. Individuals who work in the shipping or transportation roles or repair, maintenance and installation ones are also at significantly higher risk of getting hurt on the job than others.

Three of the top ways that workers get hurt are during struck or crushed by incidents, overexertion and during slips, trips and fall ones.

According to NSC, at least 26% of workplace injuries result from a worker being caught in between or struck by different pieces of equipment or objects.

Overexertion injuries account for 33.54% of injuring accidents that occur in the workplace. These injuring accidents are caused by workers repetitively bending, lifting and engaging in other types of repetitive motions.

Another type of injuring accident that often occurs in the workplace is a slip, trip and fall. This incident accounts for 25.8% of all injuries. Falls like this can happen both at the same and to lower levels.

Workers who suffer injuries on the job should first report them to their employer then immediately seek out medical attention from a physician. If your employer refuses to cover your health care costs or lost wages, then you may need to pursue legal action against them. A workers’ compensation attorney can advise you of any options that you may be able to pursue in your case if you’ve been injured on the job in Goldsboro.

The North Carolina Industrial Commission (IC) is responsible for managing both the Workers’ Compensation Act and the Torts Claims Act. They process claims for these programs and make sure that injured workers receive efficient medical and rehabilitative care. They also facilitate safety training programs. They recommend that individuals hurt on the job follow certain steps to ensure that their case is adequately handled.

One of the first steps that the IC recommends for all workers to take after becoming hurt on the job is to report their injuries to their employer. They note that your employer should refer you to a medical provider of their choosing once you do.

If you work off-premises, then they recommend for you to proceed to your nearest doctor or hospital instead. You’ll want to reach out to your employer and report your injuries as soon as possible after that. You can also have a friend, loved one or a member of your medical team do this for you.

If your employer refuses to refer you to a health care provider, you should immediately consult with a health care provider of your own choosing. It’s important that you let them know who your employer is and that you were injured while at work.

It’s important that you speak with your employer, so they can complete an incident report as soon as possible. If you were hurt so severely that they didn’t have time to speak with you, then the best thing that you can do is draft a letter to your employer providing the date of the incident and the nature of your injuries. You should provide your employer with this within 30 days of your injuring incident.

You should follow your doctor’s orders after you’ve been injured on the job. By doing so, you’ll give yourself the best shot of being restored to your healthiest you. This will give you the best chance of making it back to work.

Some employers are extremely responsive in handling workers’ compensation claims. Others are so small or disorganized that they handle such incidents poorly. Employers sometimes try to blame a worker’s injuries on the employee’s negligence instead of accepting that they were liable themselves.

A workers’ compensation attorney can help you work through this to make sure that you receive the benefits that you have a right to here in Goldsboro.

U.S. Department of Labor (DOL) statistics show there were as many as 145,000 warehouse workers here in North Carolina and around the country as of 2011. Worker injuries are sadly commonplace in these facilities. They often result in employees missing time from work and pay in the process. There are some trends as to when these injuries occur.

Some common types of injury that occurs in a warehouse are pushing, reaching, lifting and pulling ones. Slips and falls, forklift and material handling ones also occur more frequently than others.

Most warehouse injuries happen in materials storage areas or on docks. They also happen to those who are responsible for package handling or manual lifting, to those operating forklifts and working alongside conveyor belts.

Forklift injuries

Data published by the Occupational Safety and Health Administration (OSHA) shows that over 20,000 workers suffer injuries in forklift accidents on an annual basis. At least 100 workers die in similar types of incidents.

At least a quarter of all forklift accidents occur when it overturns on them. Others happen because its racks are too small, have altered configurations or are damaged. Others come from rearranging or damage and improper use of the forklift.

Slips and falls

DOL statistics show that slips, trips and falls are one of the leading “general industry accidents.” That same data reveals that as many as 95 million workers are forced to miss work after becoming injured in these types of incidents each year. Their data also shows that this type of injury accounts for 25% of all workers’ compensation claims filed. It also results in 15% of all employees’ accidental deaths.

OSHA regulators often aren’t called in to investigate potentially dangerous workplaces until after someone has been seriously hurt or injured.

If you’ve been hurt on the job, then you shouldn’t have just any workers’ compensation attorney handle your case for you. You should instead have one who has access to state-of-the-art research technology and a skilled legal team handle it for you. By doing so, you’ll have the best chance of recovering the compensation that you deserve in your Goldsboro workplace accident case.

If you’re injured on the job, it’s natural to have some concerns about the future. From the impact on your finances to your ability to make a full recovery, there will be a lot going through your head.

Any on-the-job injury, even one that you consider minor, should be followed up with a medical exam. Furthermore, don’t wait to report the incident and your injuries to your employer.

It’s your hope that you file a workers’ compensation claim and receive immediate benefits, but this doesn’t always happen. Some of the most common reasons for a denial include:

Did not report the injury in time

Did not request medical treatment for the injury

Did not file a workers’ compensation claim in time

Employer disputes the claim, often arguing that you were not injured at work

A workers’ compensation denial is frustrating, but there are steps you can take to protect your legal rights. Do the following:

Review your denial letter to better understand the reason

Make note of any key dates

Collect information, such as evidence of your injury occurring at work

It’s a challenge to file a workers’ compensation claim, as it’s a complicated legal process that’s not always easy to understand. Depending on the circumstances, you may have to present your case at a hearing.

Despite the setback, don’t hesitate to learn more about filing a workers’ compensation claim by contacting an attorney. You have the right to receive compensation, so you should do whatever it takes to protect your legal rights.

Many businesses throughout North Carolina are hiring part-time employees these days. But often these workers are slotted directly into their positions with little or no training. And that’s a big problem. While anyone can suffer on on-the-job injury, new employees and those with little training are far more likely to get injured than experienced workers.

Workers’ Compensation Eligibility in North Carolina

For an injured part-time employee, an important question arises: Am I covered by workers’ compensation insurance? For almost all part-time workers in North Carolina, the answer is yes.

The North Carolina Workers’ Compensation Act requires all employers with three or more employees to provide coverage, whether the employee is full-time, part-time or seasonal. There are some exceptions however. Independent contractors can be excluded from coverage, but the North Carolina Industrial Commission may still find independent contractors to be employees for the purposes of the Workers’ Compensation Act based on several factors.

What to Do If You Have Been Injured

A high percentage of part-time employees perform manual labor. Some must work strenuously, particularly stock room assistants, warehouse workers, and cleaners. These conditions increase the potential for on-the-job injuries.

If you suffer an injury while working, do the following:

Get appropriate medical care as soon as possible, either from an employer-designated medical provider, at an emergency room, or from your own doctor

Tell the medical provider that your injury was work-related and provide the name of your employer. Make sure to tell the doctor about all your symptoms, even if you don’t think they could be related to your accident.

Report the injury to your employer. If you are unable to do this yourself, a family member, friend or another party can do this for you.

Within 30 days of the accident, provide written notice to your employer. State the date of the accident and give a brief description of your injury.

Follow the instructions of your doctor and do not stop medical treatment until your doctor says you can.

If your claim is denied, your benefits prematurely terminated, or you don’t think you are getting the medical care you need and the benefits you are entitled to, get legal advice. An experienced workers’ compensation attorney can review your situation, and if necessary, take action on your behalf.

Health care is an important industry that protects the well being of all North Carolina residents. Unfortunately, some of our health care workers, including nurses, doctors and staff, suffer injuries while they are helping others.

If you are injured while working at the hospital, you may be entitled to workers’ compensation benefits. These benefits can help you pay for medical bills and cover lost wages as you recover. However, filing a claim does not guarantee recovery. Do you know what steps to take to increase your claim’s chances of success?

Key steps to increase your claim‘s chances of success

Once you experience an accident, or notice a repetitive strain from your occupational tasks, you should take certain steps to protect your right to workers’ compensation benefits. Filing for workers’ compensation is not the same as suing your employer. It is more similar to filing an insurance claim. If you are injured:

Notify your employer immediately. You must inform your employer to initiate the claim process. You should notify them as soon as possible in order to start collecting benefits.

Seek medical attention. Undergo necessary medical treatment and ensure that your medical provider thoroughly records all injuries. They should be notified that you will be filing for workers’ compensation benefits.

Record information about your injury. Keep a detailed journal about the nature of your injury, the name and contact information of any accident witnesses and photos of visible injuries. This information can be used to prove the extent of your injury.

Complete a claim form. Injured North Carolina workers must complete a Form 18 workers’ compensation claim form. It should be completed within 30 days of your accident, and will not be accepted if it is filed after two years of the injury date.

Follow up with your employer. Ask them about the status of your claim and make sure that everything is correctly submitted. You should soon hear whether your claim was accepted or denied.

What can you do if your claim is dismissed?

If your workers’ compensation claim is wrongly dismissed, you can still take action to secure benefits. You have a right to request a hearing with North Carolina’s Industrial Commission. The commission will then evaluate whether you can collect benefits from your employer.

An experienced attorney can carefully evaluate the nature of your injury and advocate on your behalf. They understand the intricacies of the workers’ compensation process and how to provide your case with the best chances of success.
